Στα ίχνη τεσσάρων Ελλήνων που φαίνεται να έχουν αγοράσει το φρικιαστικό βίντεο με τον βασανισμό και τον βιασμό σε μπανιέρα ενός κοριτσιού ηλικίας 7-10 χρόνων βρίσκονται οι διωκτικές αρχές, στο πλαίσιο μιας παγκόσμιας έρευνας με την κωδική ονομασία «Τίγκερμπελ» για την εξάρθρωση ενός εκ των μεγαλύτερων κυκλωμάτων παιδικής πορνογραφίας.

Προστατέψτε τα παιδιά μας από τους παιδεραστές
Σύμφωνα με αποκλειστικές πληροφορίες της «Εspresso», δέκα αστυνομικοί απ’ όλο τον κόσμο -μεταξύ των οποίων και ο προϊστάμενος του Τμήματος Δίωξης Ηλεκτρονικού Εγκλήματος της Ασφάλειας Αττικής Μανώλης Σφακιανάκης- συντονίζουν τη διεθνή επιχείρηση «Τίγκερμπελ».
Πληροφορίες από τη Γιουροπόλ αλλά και την Ιντερπόλ αναφέρουν ότι πρόκειται για μία από τις μεγαλύτερες επιχειρήσεις που έχουν στηθεί ποτέ. Στόχος της, ο εντοπισμός και η σύλληψη των ανθρωπόμορφων τεράτων που το 2005 βασάνισαν άγρια σε μια μπανιέρα γεμάτη νερό ένα κορίτσι ηλικίας 7 έως 10 ετών, το οποίο βίασαν με άγριο τρόπο και στη συνέχεια μάλλον το έπνιξαν, αφού στο ανατριχιαστικό αυτό βίντεο οι βιαστές στο τέλος κρατούν το κεφάλι του άμοιρου παιδιού μέσα στο νερό.
Στη νέα, τεράστια διεθνή επιχείρηση «Τίγκερμπελ» παίρνει μέρος και η Ασφάλεια Αττικής, καθώς έχουν ανιχνευτεί στη χώρα μας τουλάχιστον 200 ηλεκτρονικά ίχνη επισκεπτών συγκεκριμένης ιστοσελίδας που περιλαμβάνει αυτό το βίντεο της ντροπής. Σύμφωνα με αυτά τα 200 ηλεκτρονικά ίχνη, που έχουν σταλεί από την Ιντερπόλ στην Ασφάλεια Αττικής, Ελληνες χρήστες του Διαδικτύου έχουν μπει στη συγκεκριμένη ιστοσελίδα και μάλιστα φέρονται να έχουν αγοράσει μέσω πιστωτικών καρτών βίντεο με άγριο παιδικό πορνό. Η πιο σημαντική, ωστόσο, πληροφορία που έχει περιέλθει στο Τμήμα Δίωξης Ηλεκτρονικού Εγκλήματος αφορά τουλάχιστον τέσσερις Ελληνες οι οποίοι, σύμφωνα με τις εκτιμήσεις των διωκτικών αρχών, έχουν αγοράσει το πιο ανατριχιαστικό βίντεο, αυτό του βιασμού του δύστυχου παιδιού μέσα στην μπανιέρα. Κι αυτό γιατί οι πιστωτικές τους κάρτες είναι χρεωμένες με πολύ μεγάλο ποσό για αγορά από τη συγκεκριμένη ιστοσελίδα.
Ήδη σε μεγάλα αστικά κέντρα της χώρας, σύμφωνα με άριστα διασταυρωμένες πληροφορίες της «Εspresso», πραγματοποιούνται έρευνες του Τμήματος Δίωξης Ηλεκτρονικού Εγκλήματος. Μέχρι στιγμής τα αποτελέσματα των ερευνών αυτών οδηγούν -γι’ άλλη μια φορά- σε ανθρώπους υπεράνω πάσης υποψίας που επισκέπτονταν καθημερινά τη συγκεκριμένη ιστοσελίδα, στην οποία απεικονίζονται ακόμα και παιδιά από ενός έως έξι ετών να κακοποιούνται βάναυσα από ανθρωπόμορφα τέρατα.
Οι διωκτικές αρχές σε Ευρώπη και Αμερική έχουν απλώσει ένα πολύ πυκνό δίχτυ σε μια προσπάθεια να πιάσουν τους χειριστές αυτής της ιστοσελίδας και να τους οδηγήσουν στη Δικαιοσύνη για τα ειδεχθή εγκλήματα που έχουν διαπράξει.
Ήδη, σύμφωνα με πληροφορίες, έχει εντοπιστεί ο σέρβερ της ιστοσελίδας σε περιοχή της Λατινικής Αμερικής. Στην ίδια περιοχή εκτιμάται ότι κινηματογραφούνται και τα βίντεο με το σκληρό πορνογραφικό υλικό, που αφήνουν άφωνους από τη φρίκη όλους τους φυσιολογικούς ανθρώπους, εκτός από τις αρρωστημένες ψυχές που αρέσκονται στην παρακολούθηση τέτοιων θεαμάτων.
Η πρώτη έρευνα
Με αφορμή το ίδιο βίντεο είχε στηθεί και άλλη μια μεγάλη διεθνής επιχείρηση εντοπισμού και σύλληψης παιδόφιλων με την κωδική ονομασία «Τσάρλι», στην οποία επίσης είχαν πάρει μέρος οι ελληνικές διωκτικές αρχές. Στο πλαίσιο εκείνης της επιχείρησης είχαν συλληφθεί τον περασμένο Νοέμβριο στη χώρα μας δεκαέξι άτομα, ενώ είχε σχηματιστεί δικογραφία σε βάρος άλλων πενήντα πέντε.
Το βίντεο αυτό, όταν είχε πρωτοκυκλοφορήσει, βγήκε σε ανατριχιαστική δημοπρασία μεταξύ παιδόφιλων και πρώτος το απέκτησε το 2005 ένας Γερμανός επιχειρηματίας έναντι 300.000 ευρώ. Η τιμή του σήμερα έχει πέσει και κυμαίνεται μεταξύ 5.000 και 10.000 ευρώ.

Bork refers to our self-identified intellectual elites whom Kenneth Minogue calls the Olympians.Olympianism is a secular religion which does not recognize itself as a religion. Its acolytes, until recently concentrated in the universities and the mainstream media, claim superior knowledge which they will share with, and if necessary impose upon, the rest of us. The bad news is that this class is growing and taking root in the general population, both here and in all the industrial democracies of the West. The most powerful educational and political weapon in the Olympian's arsenal is the United States Supreme Court and the inferior federal and state judiciaries. Over time, the courts tend to adopt the values of the dominant culture, and that culture today, and for the foreseeable future, belongs to the Olympians.The reason the judiciary is such a valuable ally to any class or political movement is that the courts, when purporting to speak in the name of the Constitution, even if they speak falsely, are the only institution in America that claims absolute finality for its decisions and is accorded that superior status by all other bodies. The Constitution provides no check upon the courts other than the highly uncertain authority to appoint new judges when vacancies occur. A series of unpleasant surprises in the behavior of new judges suggests that the appointment power is not much of a safeguard.Bork notes the same phenomenon of judicial supremacy is being taken up by other nations of the West, with results similar to ours: an unjustified diminution of democracy, the erosion of national sovereignty, and a judicially imposed movement of the culture to the left. Those results seem to be in the nature of the beast because of the alliance everywhere of the intellectual class and the judiciary.We must ask ourselves whether we continue to understand courts with the power of judicial review. Some inkling of answer may be found by comparing the views of two prominent men, one of the founding generation and the other a contemporary of ours. I refer to Alexander Hamilton and Justice Anthony Kennedy.Hamilton expressed the original view of the Framers. Downplaying the danger the anti-Federalists saw in a powerful national judiciary, he wrote in Federalist 78 that "the judiciary, from the nature of its functions, will always be the least dangerous to the political rights of the constitution" because it does not command the sword and the purse and has "neither force nor will, but merely judgment." He quoted Montesquieu: "of the three powers [legislative, executive, and judicial]...the judiciary is next to nothing."That was then. Contrast Justice Kennedy's view. In an interview, he stated his understanding of the role of a justice on the Supreme Court: "You have the opportunity to shape the destiny of this country. The Framers wanted you to shape the destiny of the country. They did not want to frame it for you." Why men who did not want to frame anything should be called the Framers was not explained. At the Philadelphia Convention, they argued long and hard, drafted and redrafted, almost as if they thought they were framing a government to last, but apparently they were simply handing the United States over to a small clutch of judges who would take the nation in unanticipated directions without regard to either the Constitution or the desires of the people.Justice Kennedy's remarks were no slip of the tongue, as shown by his further statement. "You know," he said, "in any given year, we may make more important decisions than the legislative branch does--precluding foreign affairs, perhaps. Important in the sense that it will control the direction of society." He merely has the candor to articulate what is implicit in their decisions.Bork muses the Court's performance strikes at the heart of the concept of a republic. Without any warrant in law, nine lawyers split five to four, and the judgments of Congress, the President, state legislatures, governors, other federal judges, and the judges of all 50 states all are made instantly irrelevant. Whatever else it is, that is not democracy or a republican form of government. It is a robed oligarchy. You will hear it argued that to apply the term "activism" means no more than that you don't like a case's outcome. That is not true, and people who talk that way are, whether they realize it or not, implicitly saying that there are no criteria for judging the goodness or badness of a case other than personal or political sympathy.Bork points out "Activism" has a real meaning, and it is an indispensable term in our debates. A judge is an activist when he reaches results or announces principles that cannot plausibly be derived from the actual historic Constitution. The historic Constitution is the set of principles that the ratifiers, who made the Constitution law, understood themselves to be enacting--the original understanding. That approach is now called "originalism," and under no other approach can we have any semblance of the rule of law, which means in turn that no other approach is compatible with a republican form of government. Activism means lawlessness, and it is rife among many judges and most professors of constitutional law.Bork points out the rule of law requires that the principles announced and relied upon by judges be neutral in their application. Neutrality requires that a principle, once chosen, be applied according to its terms to all relevant cases without regard to the judge's personal views of the parties or issues before him.That is a powerful discipline, for in deciding Case A he must realize that he has committed himself to decisions in future cases that fall within the principle but whose particulars are at the moment unknown to him. That counsels great care in choosing and articulating the principle which he advances as dispositive in Case A. Should the principle prove unsatisfactory in Case B, the judge's only recourse is to reformulate it with a full explanation of his reasons.It is not sufficient, of course, that a principle be neutrally applied. That requirement would be met if the judge chose the principle that a labor union always loses and applied it neutrally, no matter the merits of a particular case. The principle chosen must also be neutrally derived, chosen without regard to the judge's individual preferences. The only source for principles that minimize or eliminate the judge's biases is the Framers' original understanding of the principles they were making into law. The morality and the policy enforced come from outside the judge. The judge who looks outside the historic Constitution looks inside himself and nowhere else.No judge can possibly avoid seeing a case without his own worldview coloring his vision. But there is a chasm between a judge who knows that and consciously strives for objectivity and a judge who knowingly undertakes to impose his vision of justice upon the parties before him and upon the society. Yet, largely through intellectual critique, reform has been achieved. She was found to have a blood-alcohol level three times above the legal limit. The 51-year-old resigned Wednesday effective immediately, saying she could not stay in office without losing much of the authority she'd need for the post.Reaction across the board was that Kaessmann's decision was understandable. I accepted the resignation with respect and also regret. I have very much valued the cooperation with Bishop Kaessmann. I called bishop Kaessmann, and I asked her to reconsider. I pray to God for a miracle to stay in her job, because all Christians in the world need her. The religious affairs spokesman for the opposition Left Party in parliament, Raju Sharma, also came out in support of the bishop: Bishop Kaessmann is like we all are - a person with failures and weaknesses. We are all sinners, and so is bishop Kaessmann. She never said she's impeccable in any way.Katrin Goering-Eckardt, president of the German Lutheran Synod, said Kaessmann made a serious mistake which she admits and regrets, adding that she has accepted the consequences and we must respect and understand that, even if it's hard for us to do so.The Evangelical Church of Germany(EKD) meanwhile admitted that Kaessmann's resignation was a heavy loss for German Protestantism. It is also a great personal loss for EKD. The Council of the EKD expresses its unanimous faith in Margot Kaessmann.The deputy chairperson of the EKD council, Nicholaus Schneider, would assume the presidency until new elections can be held. The most likely date for any elections would be November 5-10, when the next EKD synod is to take place in Hanover, the statement said.Margot Kaessmann has earned more than our respect, she has earned our esteem. She has committed an error though has not attempted to cover it up, but rather has clearly and quickly confessed her guilt. This makes her a model. Kaessmann's decision to step down from her post was a sign of her enduring moral standing. Her straightforward nature and her courage have roused us. Margot Kaessmann needs no bishop's title. Her honorary title is that of a courageous woman.Margot Kaessmann is untarnished by this incident,and she should be forgiven. Kaessmann was, is. and will remain a remarkable personality, pugnacious, sometimes contrary, but always straightforward. The fact that this woman has resigned under these circumstances, because of this drink driving incident, after a very public divorce and an open battle with cancer, signals a crazy situation. No one would dare resign over kleptocracy, tax dodging, or a donations scandal. But a red traffic light is another matter. Even Jesus would have to wonder.Venitis asks you to consider Kaessmann's personal problems, her divorce, her fight with cancer, her fight with misogynists, her fight with warmongers, and give her a second chance. Kaessmann, as a smart woman, must have realized that religion is spiritual slavery. Church is the business of religion. Religious monopoly turns bishops to ayatollahs, and churches to Sodom and Gomor. Spirituality and metaphysics should replace religion. Venitis asserts that Faith is retarded thinking that keeps you away from God. You have to become faithless, in order to start your journey to God! You have to discover God your own way without intermediaries. God's truth should replace faith.

Παρά την πικρία και την απογοήτευση από τα πενιχρά αποτελέσματα της Κοπεγχάγης συνεχίζουμε να ελπίζουμε πως μπορεί να υπάρξει μια καλή και φιλόδοξη παγκόσμια συμφωνία. Από την πλευρά μας θα αγωνιστούμε όλοι, με όλες μας τις δυνάμεις, σε εθνικό και διεθνές επίπεδο.
Πρόκειται για έναν αναμφίβολα δύσκολο αγώνα, τον οποίο μπορούμε να κερδίσουμε αν έχουμε την υποστήριξή σας. Η Ώρα της Γης, είναι μια συμβολική παγκόσμια δράση που ενδείκνυται για να κινητοποιήσει εκατομμύρια ανθρώπους σε όλο τον κόσμο, αποδεικνύοντας ότι η φωνή των πολιτών παραμένει δυνατή και καλεί σε άμεση δράση ΤΩΡΑ!

I congratulate President van Rompuy for what was a very good Informal European Council for the first time under his chairmanship. After reaching agreement among all of us on the important statement on Greece, we have discussed the Europe 2020 Strategy. Then I had the opportunity to focus on the substantial policy issues we are facing, on the challenges, and on the lines which the Commission will formally propose next Wednesday. Before the crisis, the European economy was making progress. We saw 18 million new jobs, a more dynamic business environment. But these gains have been wiped out. A 4% fall in GDP in a single year, unemployment shooting up to 10%. A huge hit to our prosperity, and a real threat to our society.And at the same time, the task is getting tougher. We have an ageing population, a growing productivity gap with our competitors, and failings in education and research. But we have many strengths, too, the world's biggest economy, the fact is that working together in the single market and the Euro area proved a huge asset in the crisis. Europe today faces a choice. Hoping for a return of the good old days is no option. One option is limited change, the lowest common denominator which brings some reform and some growth, but we could never get back what we lost in the crisis. This option would result in a Europe in the second class of the new global order. Minimum changes, some form of adaptation. We can and must be more ambitious. We can aspire to an economic strategy that puts Europe on the path to competitiveness that can create millions of new jobs. But this cannot be done by half measures and incremental change.We need to instil a sense of urgency, a recognition that "business as usual" will not protect our European way of life, will not defend our social model, on the contrary, that this will put it at risk. This requires a joint effort. We need the Member States, we need European institutions, we need stakeholders and society at large, and we need the active involvement and support of this Parliament, the European Parliament. For shaping this strategy, and for communicating it to the people. Next week the Commission will set out the key elements of the strategy we formally propose to the European institutions. It will centre on three priorities: smart growth, inclusive growth, sustainable growth. First, the core driver of growth must be knowledge. Knowledge and innovation that produces tomorrow's ideas, tomorrow's skills, and tomorrow's technologies.Second, to keep in force our European model of society, we need to deliver more jobs. Our goal must be healthy, prosperous, secure societies where everyone feels they can play their part. That means giving people jobs and skills, and it means tackling the scourge of poverty head on. The problem of poverty is not only national, it requires a European response. Finally, our social market economy must be hard-wired to seize the opportunities of the future. I am talking about sustainable growth, recognising the imperative of tackling climate change and the pressure on resources. And with this, I mean a competitive economy, deepening the Internal Market, creating better conditions for investment especially for SMEs – a European economy able to hold its own in a globalised marketplace.These priorities are not unfamiliar. But the fact that we have not yet succeeded in realising these goals makes them more important, not less. Where we need to make a radical change is not in our prescription of what the European economy needs, but in our approach of how to make it happen. What do we need in order to succeed?First, the strategy must be comprehensive. We cannot have a "pick and mix" strategy, allowing everyone to do the easy parts, the real feel good things, and leave the real challenges to one side. And there are still many, when I think about the single market, about the quality of our taxation systems, about the way we spend money at a time of intense pressure on public finances – to name but a few. Second, our strategy must engage all parts of our societies. We will not succeed in putting European society on the right track in 2020 if this comes at the cost of social conflict. That is why a pro-active approach to creating jobs and addressing the scourge of poverty, are essential. It is also why we have been right to reform financial markets. We want a strong financial sector able to finance innovation and help businesses to grow. One which acknowledges its broader responsibilities to societies and governments which came to its aid at the time of need. One which accepts that effective supervision at European level is necessary today. Third, we must not confuse having an overall vision for the European economy with the question of who does what. It should not be a debate of competence. We need a common approach. Still a lot of action will have to come at national level. Others and not the minor ones will come from the EU. But we will only succeed if we ready to work together, not besides and not against each other. And therefore we need credible ownership at all levels. And we need strong and true coordination in the economic field. The Lisbon Treaty gives us these instruments, and we will use them. Fourth, we need visible, significant EU-level flagship measures to typify what we are trying to achieve. Projects like an innovation plan, a new skills programme, a proper industrial policy, a digital agenda, green technologies and a specific plan of action against poverty. Projects that have a value and an impact in themselves. And which show that the EU brings action. We need venitism now! Without even bothering to pretend such authority existed in the Constitution, Lincoln offered and eventually carried out a thinly veiled threat that beyond what may be necessary for collecting taxes, there will be no invasion, no using of force against or among the people anywhere. In the words of Tony Soprano, pay up and nobody gets hurt.But perhaps, as some have said, Jefferson intended his Declaration merely as a political tool to justify American independence from Britain. He surely would never have acknowledged or defended an individual state's right to secede from the very union he helped to found. Except that he did, in his own first inaugural.Upon assuming the presidency in 1801, amidst severe political and sectional turmoil, Jefferson said that if there be any among us who wish to dissolve the Union or to change its republican form, let them stand undisturbed, as monuments of the safety with which error of opinion may be tolerated where reason is left free to combat it.In light of these facts, no serious student of history or politics could believe that Jefferson and Lincoln possessed similar visions for America. They say that the first step to a recovery is accepting that you have a problem. Venitist Israel Ortega points out in Washington, D.C. spend-happy kleptocrats haven't taken that step. They're clueless as to why our country remains in an economic recession with a national unemployment rate in double digits. And even though kleptocrats have repeatedly tried and failed to stimulate American economy with costly spending bills, they're considering even more spending in the months to come.Instead of looking at other ways at stimulating American economy, Congress is bent on sticking to their spend-happy ways - which would further add to our ballooning deficit. Basil Venitis asserts that throwing money to misery brings more misery. Fighting wild leverage with more leverage is homeopathic repression of reality. A deluge of fiat money brings financial plague and haemorrhage of economy. Real money is tied up to precious metals and strategic metals.Just a year ago, Planetarch Obama signed the "American Recovery and Reinvestment Act," promising us a swift economic recovery by putting more Americans to work. However upon closer inspection, it's clear that the so-called "stimulus bill" was nothing more than pork-barrel spending. Venitis has proven that for each percent of lower taxes, the economy grows by at least four percent more, and the government gets more revenue. Raising tax rates is masochism. Smart stimulus is to cut tax rates. Stupidus stimulus is to increase spending, which stimulates the cancer of socialism!Skeptics of the stimulus bill have been vindicated a year after we faced harsh criticism from many antivenitists. Recent statistics show the unemployment rate hovering around 10 percent. And according to The Washington Post, the unemployment rate for Hispanics stands closer to 13 percent. In light of these figures, it's fair to say that our economy is struggling and the stimulus bill has failed.Ortega muses the White House continues to insist that this massive piece of legislation was a resounding success. In fact, it wasn't long ago that the administration claimed the stimulus bill had "saved or created" a large number of jobs (the actual number changed repeatedly). The White House has since stopped this practice, since there's no verifiable way of attributing job growth to the stimulus bill. And yet that hasn't stopped the president from dispatching Cabinet kleptocrats to 35 communities across the country to tout the stimulus' "success."As if this weren't bad enough, lawmakers are considering another economic stimulus bill, filled with even more wasteful spending. It, too, would do nothing to improve our economy. Apparently, Congress is convinced that the third time will be the charm. The most efficient political system is venitism, where everything is private, there are no taxes at all, there is no parliament, and a powerless infinitesimal government is chosen and supported not by hoi polloi, but by the most generous benefactors.Ortega asserts that kleptocrats would do better to approve the various free-trade agreements that remain stalled in Congress. By opening our markets through increased trade, we could create more jobs here in our country. Already-negotiated, "shovel ready" U.S. trade agreements with Colombia, Panama and South Korea are being held up in Congress because powerful labor unions oppose them.These unions helped to craft President Obama's current trade policies. Antivenitists don't want to upset these powerful labor unions and put their hefty political campaign donations at risk. Venitis asserts that every democracy is eventually hijacked by rabblerousers, pullpeddlers, clans of kleptocrats, bumptious bugaboos, busybodies, butterbabies, nabobs of nepotism, cranks of cronyism, pusillanimous pussyfooters, riffraffs of rascals, socialist sophists, and machiavellian mafiosi. Democracy tends to kleptocracy. Venitism should replace democracy.Ortega asserts that politics shouldn't interfere with sound policy decision-making. In our recently published 2010 Index of Economic Freedom, trade analysts and economists showed the benefits that increased trade can have on economies. In an increasingly globalized world, protectionism is simply lousy policy.Instead of writing another blank check for yet another stimulus bill, kleptocrats could consider cutting tax rates for more Americans. Doing so would return more of our hard-earned money, and allow individuals to decide for themselves when and where to spend it. Similarly, reducing taxes would be particularly beneficial for small-business owners, who could decide to use some of that money to expand their businesses or hire additional workers.Basil Venitis, twitter.com/Venitis, asserts that when an economy suffers from erectile dysfunction, via-grab does not work, but only via-cut. The via recommended is to cut taxes, not grab more taxes. There are limits to how much government can tax before it kills the host. Even worse, when government attempts to subsidize prices, it has the net effect of inflating them instead. The economic reality is that you cannot distort natural market pressures without unintended consequences. Market forces would drive prices down. Government meddling negates these pressures, adds regulatory compliance costs and layers of bureaucracy, and in the end, drives prices up. Sadly, none of these ideas are on the table as Congress and the president march forward with plans for spending our money protecting union jobs and punishing American consumers. Many of us have no choice but to pay off credit card and utility bills at the end of every month. But Congress seems to believe it can continue spending incessantly without a worry in the world. At this rate, we'll eventually see our taxes go up. And all to satisfy Congress' appetite for spending, unless politicians get a clue.

Venitist Robert Bork points out that uncertainty about America's prospects is not new. As Benjamin Franklin exited the Constitutional Convention in Philadelphia for the last time, a woman asked him, "What have you given us?" He answered, "A republic, if you can keep it."A republican form of government is about legitimate processes rather than results, except in those few instances in which the nation has adopted self-denying ordinances, such as our Bill of Rights, that rule out certain results. Obviously, those ordinances must be carefully construed so that they are effective but do not encroach on the legitimate powers of majorities. A corollary is adherence to the rule of law, for only such adherence can ensure that the will of the majority is not altered or subverted in its application to particular cases so that the power to govern is effectively denied to the majority.Perhaps something like this is what Franklin had in mind. If so, he may have been worried about the displacement of majorities by oligarchies. Franklin was right to suggest that the success of the Republic was contingent, so it was, and so it is, and so it will always remain. There will always be people, often in well-funded organizations, who prefer the victory of their interests to republican processes. The danger becomes acute when the citizenry no longer appreciates the virtues and vulnerabilities of a republic. As Walter Bagehot put it, "The characteristic danger of great nations, like the Romans and the English, which have a long history of continuous creation, is that they may at last fail from not comprehending the great institutions which they have created."Bork notes that in America's case, the great institution we have created and may be failing to comprehend is judicial supremacy: the power we have accorded courts to correct, and do so with finality, the other branches of the federal government and all branches of state governments. The judges need only announce that these other branches and governments have strayed from the principles contained in our written Constitution. Never mind that the power of judicial review is nowhere mentioned in that Constitution or that that power was established in very dubious fashion in Marbury v. Madison (1803).The nation ultimately acquiesced, and a great institution was born--great in its capacity to do much good but also dangerous when it employs its powers to accomplish ends outside the law. After all, after Marbury came Dred Scott(1856), which denied the federal government the power to prevent slavery in any state or territory or to permit a state to bar slavery within its borders. Perhaps it should have been seen as ominous that these two cases, one greatly admired, the other now universally despised, were both instances of what today we call judicial activism.Basil Venitis points out that the Supreme Courts in many European countries are manipulated by their governments.
